1. INTRODUCTION
Welcome to ABC WORLD, an educational service for children delivered through a Mobile Application ("The App" or "The Service") provided by PLEIQ SMART TOYS SPA ("The Company"), a Chilean company that provides digital education services, located in the city of Santiago, Chile. These Terms and Conditions (hereinafter, the "Terms" or "Conditions"), are applicable and regulate the services of ABC WORLD, a mobile application available through cell phones, mobile devices, and in general, from any type of device that allows you to download applications, browse web pages or any other means used by ABC WORLD and made available by The Company. By accessing and using ABC WORLD's services, you agree to be legally bound by these Conditions, which establish a contractual relationship between you and PLEIQ SMART TOYS SPA. This page, application, its content, structure, infrastructure and services are made available to you in accordance with the terms and conditions specified below: Access and use of the services offered is subject to your prior acceptance of these conditions and the use of any of the products or services provided will be understood as acceptance. Supplementary and/or complementary conditions may be applied to certain Services or Products, such as policies for an event, an activity, or a particular promotion. These supplementary conditions will be communicated to you in relation to the applicable services. The supplementary and/or complementary conditions will be established in addition to the Conditions, and will be considered part of these, for the purposes of the applicable services or products. During the period of activities or special offers, the supplementary and/or complementary conditions will prevail over the Conditions, in case of conflict with respect to the applicable services. PLEIQ SMART TOYS SPA may modify the Conditions relating to ABC WORLD's products and services when it deems appropriate. The modifications will be understood as current, known, and therefore, will be applicable, from the exact date of update by PLEIQ SMART TOYS SPA, through the communication channels of ABC WORLD, the Application, via the Web and/or in the specific conditions of the promotion or particular event in question. The access or use of services from that moment on will be understood as acceptance of the modifications published by PLEIQ SMART TOYS SPA. The collection and use that we make of personal information in relation to the services and/or products offered will be in accordance with the provisions of the "Privacy Policy of ABC WORLD", which is an integral part of these Conditions.

2. DEFINITIONS:
"PleIQ Smart Toys", "we", "our", "the company", refer to "PLEIQ SMART TOYS SPA". "ABC WORLD", "Application", "App", "Product", "Services": is the mobile application designed by PLEIQ SMART TOYS SPA for digital educational content based on the concept of Multiple Intelligences, the Universal Design for Learning, with games in Augmented Reality and Virtual Reality, designed for children ages between 3 to 10 years. "User", "Client": refer to the person who downloads the application on their mobile device. Our user must be of legal age and have the capacity to enter a contract and will be responsible for managing the user account and supervising the use made of our products and services. The "Profile": is the child's personalized game account, created and supervised by the "User" that will allow them to play and make use of the mobile application.

2.1 OUR PRODUCTS AND SERVICES ABC WORLD is an educational application with games and experiences in Augmented Reality, Virtual Reality and Mixed Reality, designed to stimulate multiple intelligences, through the combination of traditional educational activities and digital games with emerging technologies, thus reinventing the way of playing and learning. Our App uses content that is adapted for a bilingual education, in Spanish and English, with virtual and augmented reality experiences that are playful in nature to increase interest in self-taught learning. ABC WORLD offers 8 different learning worlds, the Linguistic world, the Logical-Mathematical world, the Natural world, the Visual world, the Musical world, the Kinesthetic world, The Interpersonal world, and the Intrapersonal world. In a transversal way, all the worlds contain educational activities, stories to enhance the skill of reading comprehension, and mini games. In addition, there’s a virtual pet that motivates the user to interact with and continue discovering new worlds. To enjoy the Augmented Reality, Virtual Reality and Mixed Reality experiences, it is necessary to download the App on a mobile device with the following description suggested by Apple Inc for the use of Arkit, iOS devices must have an A9, A10 or A11 processor. 3. ACCEPTANCE OF THESE TERMS
By clicking "Continue" to register and use our products and Services, you agree to be bound by these Terms and by the "ABC WORLD Privacy Policy".

4. REQUIREMENTS AND USER CONDUCT ABC WORLD's products and services are designed for use from the age of 3, and without prejudice to this, the client who downloads the App must be a person of legal age, with the legal capacity to contract, who will supervise the use of the App and may not authorize third parties to supervise the use of the app by children. Account registration requires you to communicate certain personal information to PleIQ, so we may request certain information such as: your name, address, email, date of birth, mobile phone number, as well as at least one payment method. valid, among others. Unless PleIQ allows otherwise in writing, you may only have one Account. Users guarantee and are exclusively responsible for the veracity, accuracy, validity and authenticity of all information provided, provided and/or registered on our Platform, and incorporated in their Account, undertaking the responsibility to keep it duly updated. PleIQ is not responsible in the event that said information is not truthful, exact and current. You may not assign or otherwise transfer your Account to any other person or entity. You agree to comply with all applicable laws when using our Products and Services, and you can only use them for legitimate purposes, being strictly prohibited from using them directly or indirectly for non-legal purposes.

5. ACCESS TO THE NETWORK AND DEVICES You are responsible for obtaining the necessary data network access to download and use the App. The data and message rates and fees of your mobile network may apply if you access or use the Application from a wireless device and you will be responsible for said rates and fees. You are responsible for purchasing and updating compatible hardware or having the necessary devices to access and use the Application. PLEIQ SMART TOYS SPA does not guarantee that the Application will work on any particular hardware or device. Both accessing our site and the use that you make of our products or services through third parties will correspond to contractual relationships with third parties, for which PLEIQ SMART TOYS SPA cannot be held responsible.

6. RESTRICTIONS
You may not: (i) remove any copyright, trademark or other trademark proprietary notices from any part of the Application; (ii) reproduce, modify, prepare derivative works on the content of the Application, distribute, license, lease, resell, transfer, publicly display, publicly present, transmit, retransmit or otherwise exploit the Application, except as permitted expressly by society; (iii) decompile, reverse engineer, or disassemble the Application; (iv) link, reflect or frame any part of the Application; (v) cause or launch any program or script for the purpose of extracting, indexing, analyzing or otherwise prospecting for data from any part of the Application, unduly overloading or blocking the operation and/or functionality of any aspect; or (vi) attempt to gain unauthorized access or damage any aspect of the Application or its related systems or networks.

7. WARNING
ABC World is suggested for use from the age of 3. The products and services designed and developed by PLEIQ SMART TOYS SPA are complementary educational tools and are not substitutes for formal education. PLEIQ SMART TOYS SPA suggests that parents, educators and representatives take into account and respect the suggestions on the use of mobile devices and the appropriate exposure time in children, which are made by national and international pediatric medical institutions.

8. LIMITATION OF LIABILITY
PLEIQ SMART TOYS SPA SHALL NOT BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE DAMAGES, INCLUDING CONSEQUENTIAL DAMAGE, LOST PROFIT, LOSS OF OPPORTUNITY, LOSS OF DATA, PHYSICAL INJURY, PROPERTY DAMAGE, OR FOR ANY DAMAGE OR INJURY ARISING FROM THE USE OF ANY OF THE SERVICES OFFERED AT ABC WORLD, EXCEPT WHEN PLEIQ SMART TOYS SPA HAS BEEN ADVISED OF SUCH RISKS OR DAMAGES. THE LIMITATIONS IN THIS SECTION ARE NOT INTENDED TO LIMIT THE LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER WHICH CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

9. DISCLAIMER
In accordance with the limitations indicated in these terms and conditions, and to the extent permitted by Law, neither PLEIQ SMART TOYS SPA, nor its directors, partners, employees, representatives, subsidiaries, affiliates, parents, affiliated companies, distributors, licensees , attorneys-in-fact OR any related person, will be liable to Users regarding: a) Punitive, special, direct or indirect loss or damage, loss of production, profits, income, contracts, as well as loss or damage to customers or reputation and loss of lawsuits; b) Errors related to the description of the information, including the information indicated on our Website or Application, c) Losses, damages or costs (direct or indirect, consequential or punitive) that the User suffers, contracts or pays, arising or related to the use, availability or delay of the Web or Application; and/or) In general, any type of damage, including in these emergent damages, moral damages and loss of profits, direct or indirect, consequential or punitive, that the User suffers either due to acts, errors, negligence, misconduct, professional deliberation, omissions, breaches, erroneous representation, objective non-contractual liability, or (completely or partially) attributable to the Suppliers (including among them their directors, partners, employees, representatives, subsidiaries, affiliates, parents, affiliated companies, distributors, licensees, attorneys-in-fact and any related person), whose products or services, directly or indirectly, are available, offered or promoted, including any cancellation (partial or total), strike, force majeure, or other case that is beyond the control of PLEIQ SMART TOYS SPA .

10.GENERAL DISPOSITION
All the material contained in this guide, the Application, the Teaching Material and the ABC WORLD website belongs to PLEIQ SMART TOYS SPA, for which reason their total or partial reproduction is prohibited without prior authorization. You may not assign or transfer these Conditions, in whole or in part, without the prior written consent of PLEIQ SMART TOYS SPA. You give your approval to PLEIQ SMART TOYS SPA to assign or transfer these Conditions, in whole or in part, including: (i) a subsidiary or an affiliate; (ii) an acquirer of ABC WORLD's capital, business or assets; or (iii) a successor by merger. If any provision of these Conditions is considered illegal, null or unenforceable, either in whole or in part, in accordance with any legislation, said provision or part of it will be considered not to be part of these Conditions, therefore, the legality, validity and enforceability of the rest of the provisions of these Conditions will not be affected. In that case, the parties must replace said illegal, null or unenforceable provision, in whole or in part, with a legal, valid and enforceable provision that has, to the extent possible, an effect similar to that of the illegal provision, null and void or unenforceable, given the content and purpose of these Conditions. These Conditions constitute the entire contract and the understanding between the parties in relation to the object and substitutes and replaces all previous or contemporary contracts or agreements in relation to said object.

2. PRIVACY OF THE USER
You do not need to provide us with any personal information to access our website or to view the information we provide on our website. However, we may offer you the opportunity to register with us or join our mailing list. After registering the user, ABC WORLD will not request extra personal information, such as name, surname, age, address, telephone, email or any other information of a similar nature during the game period. PLEIQ SMART TOYS SPA will collect all the usage information of the mobile application, for the purpose of internal studies on the behavior of the players within the Application, to generate reports and global studies of the use of the product, therefore it will be able to make use of all the information regarding interactions in the application. The use of the camera will only be required for the interaction with Augmented Reality, Virtual Reality or Mixed Reality. In compliance with the Children's Online Privacy Protection Act (COPPA) and its subsequent amendments, we will not request personal information from anyone under the age of thirteen (13) without the consent of their parents. Anyone who provides us with this type of information must be 13 years of age or older.
